Honolulu Rail Project – 9th U.S. Circuit Court of Appeals to Hear Case Against Rail Project


The 9th U.S. Circuit Court of Appeals has stated that they will hear the appeal of the Honolulu Rail Project’s opponents on the week of August 12, 2013 in San Francisco. In December 2012, federal Judge A. Wallace Tashima refused to completely halt rail construction, but did require the city to conduct further studies on the rail’s impact on Mother Waldron Park in Kakaako, the feasibility of creating an alternative downtown route under Beretania Street and the impact that rail would have on cultural sites along the 20-mile route. This was a separate ruling from the one made bynthe Hawaii Supreme Court in August 2012 which halted all construction until the city completed an archaeological survey of the entire 20-mile route.
Cliff Slater, one of the main opponents to the rail project, was delighted that the 9th U.S. Circuit Court would be willing to hear the appeal prior when construction is expected to resume in September 2013. Slater stated, “This is good news. We are pleased that the Ninth Circuit will likely make a final decision soon.”
