Bankruptcy Filings Decrease in November 2014

According to a report issued by the U.S. Bankruptcy Court, there were only 128 filings during the month of November 2014.  This represented a decrease of 13.5 percent as compared to the same month a year prior Jack Suyderhoud, professor of business economic at the University of Hawaii at Manoa Shidler College of Business and an adviser to First Hawaiian Bank, commented, "Bankruptcies tend to track the economy, so it's not surprising that it's down when the economy is improving, which in terms of the labor market certainly has been the case. When you look at the GDP (gross domestic product) for the U.S. as a whole, 2014 is going to end up pretty good despite the weak start at the beginning of the year. To me it's not a surprise that bankruptcies are going down in this part of the business cycle. The data we're getting on the overall economy is pretty strong. The big question is how this will carry over into 2015 given weakness in Europe and Asia and the strength of the U.S. dollar."

Bankruptcy Filings Decrease by 18.5 Percent In August 2014

According to a report issued by the U.S. Bankruptcy Court, a total of 137 cases were filed in August, which represented an 18.5 percent decrease as compared to the same month a year prior.  This marks the 14th straight month of decline on a year-over-year basis.  George Dunn, a Honolulu bankruptcy attorney, commented, "It appears the economy is improving right now and the federal government is doing a lot of things to help that in terms of keeping interest rates low. Jobs are a little bit better now than in the past and people are being more careful in creating less debt. I'm working less than 40 hours a week. It's kind of a good thing for me because I needed a break. It's kind of slowed down the last 15 or 20 months. Between the period from 2009 to 2011, I was working 80 to 90 hours a week, and I'm still recovering."

Dunn added, "The federal government might be creating a bubble. With the Federal Reserve keeping interest rates low for the foreseeable future, it looks like this (declining bankruptcy trend) could go on for one or two more years. I've been doing bankruptcies since 1988 and have been through these cycles over the years where the economy goes up and falls apart and then goes back up. So I'm expecting another crash. I don't know when it's going to be, maybe one or two years from now, but I'll be ready."

State Bankruptcy Filings Down 27.5 Percent in May 2014

According to a report issued by the U.S. Bankruptcy Court, there were a total of 150 bankruptcy court cases filed in May 2014.  This represented a 27.5 percent decrease as compared to the 207 cases filed during the same month a year prior.  Blake Goodman, a bankruptcy attorney in Honolulu, commented, "This recovery that is in place has got some teeth to it, and it's especially being played out in Hawaii. The tourism numbers are very solid. The unemployment in Hawaii is among the lowest in the country (4.4 percent). You just have to look out any window on the town side and see 11 or so cranes in the area to see that the economy has been percolating. I've been doing this about 24 years in three different states, and I've never seen such a significant downturn in bankruptcy filings."

During there first five months of 2014, there have been 746 cases filed in Hawaii.  This is a 20.6 percent decrease as compared to the 940 cases that were filed during the first five months of 2013.

Maui Real Estate – Lehman Brothers Plans to Sell Ritz-Carlton Kapalua

The Lehman Bros. Holdings Inc. has announced that they would be interested in selling the Ritz-Carlton Kapalua hotel on Maui sometime over the next few months. Lehman Brothers had helped to finance the resort before the owners filed for bankruptcy in 2008. Lehman Brothers gained control of the property after foreclosing on the loan. The hotel is located on a 54 acre resort and features a total of 463 guest rooms and suites. There are also six restaurants, a spa, and two championship golf courses on the property. Real estate experts believe that Hawaii’s improving tourism market and higher hotel occupancy rate is encouraging Lehman Brothers to liquidate this holding.
